Camping terms and conditions

McLaren Falls Park Terms and Conditions for Camping

Campers at McLaren Falls Park (“Park”) must abide by the following terms and conditions for camping.

General

Bookings

  • Where bookings are made by one person on behalf of a group, it is the responsibility of the person making the booking to ensure that all members of the group read and abide by these terms and conditions.
  • It is the responsibility of the person making the booking to check that the booking confirmation they receive correctly records their booking. Any discrepancies must be notified to Tauranga City Council within 48 hours of the booking being made or discrepancies will be deemed unalterable.
  • Refunds will only be given for cancellations notified at least five (5) days prior to the commencement of the booking. Bookings cancelled within five (5) days of the commencement of the booking will not be refunded.
  • No refunds for early departure.
  • Stand-alone tents and campervans are the only modes of camping allowed in the Park. Charges for campervans are the same as for camp sites.

Length of Stay

  • Maximum duration of stay is three (3) consecutive nights.

Access to the Park

  • Park gate open hours are:
    • Daylight Saving: 7.30am – 7.30pm
    • non Daylight Saving: 7.30am – 5.30pm
  • Access to the Park is only available during open hours.
  • Maximum speed limit for all vehicles in the Park is 15km/hr at all times.
  • No vehicles are to be driven in the Park (including around camp sites or on Park roads) after 1030pm (unless in the event of an emergency).
  • All drivers must drive and park vehicles safely at all times and be considerate of other Park users.
  • No more than three (3) vehicles per five (5) persons camping are permitted.

Arrival and Departure

  • Camping is only permitted in the following specific areas of the Park: Pin Oak, Top Flat and Hamilton Point. The Park has no designated camp sites. Locations for camping are available on a first come, first serve basis.
  • Campers may arrive throughout the day and set up on vacant camp sites. If no camp sites are vacant on arrival, please wait until after 12 noon for a vacant camp site to become available.
  • Camp sites are to be vacated by 12 noon on the day of departure.
  • All camping equipment and belongings MUST be removed from the Park on the day of departure.

Camp Facilities

  • Showers are free for paying campers only.
  • As there are toilet facilities in the Park, campervans do not need to be self-contained.
  • Please leave shower and toilet facilities clean and tidy after use.
  • Barbeques are provided within the Park for use free of charge. Please leave barbeques clean and tidy after use.
  • No powered sites or electricity charging facilities are available in the Park.
  • There is no waste disposal dump facility in the Park. All waste and rubbish MUST be removed from the Park on the day of departure.

Youth Policy

  • Persons aged 17 years and under are not permitted to camp in the Park unless accompanied by a responsible parent or guardian for the duration of their stay.

Animals

  • Campers are not permitted to bring animals into the Park (except registered service dogs and horses). Please advise the Park Ranger on arrival if you have a registered service dog. (See below for further information relating to horses.)

Horses

  • Horses are permitted in the Park but cannot be kept overnight in the Park.
  • Equestrian Area facilities are available in the Park for use by Park users.
  • Contact Susan Woodcock from the Tauranga Pony Club (klsjw95@outlook.com ) for information about the availability of, and any associated costs for using, the jumps and the Equestrian Area.
  • For further information on using the Equestrian Area and riding horses in the Park, please refer to the Tauranga City Council website (www.tauranga.govt.nz).

Conduct and Behaviour

  • Persons aged 18 years and over may consume alcohol on their own camp site only.
  • Alcohol will not be tolerated around the Park or other communal facilities.
  • Excessive consumption of alcohol is prohibited. Parties are not permitted.
  • Underage drinking is not permitted in the Park.
  • Drinking and driving in the Park is not permitted.
  • Reasonable behaviour is required at all times.
  • All activities within the Park (e.g. music, games etc) must not disturb other Park users or local residents.
  • Campers must respect the rights of other Park users at all times.
  • Complete quietness between the hours of 10.30pm and 7am is required. Noise will not be tolerated during quiet time.
  • Generators and machinery are prohibited unless the prior written approval of Tauranga City Council is obtained.

Rights of Park Ranger

  • The Park Ranger has the right, in his or her sole discretion, to:
    • direct campers to specific areas;
    • request campers to move tents, vehicles or camping equipment at any time;
    • refuse entry to the Park to any person;
    • require campers to cease inappropriate activities/behaviour;
    • require any person to leave the Park; and
    • cancel occupancy of a camp site and require campers to leave the Park immediately. No refund will be given to campers whose occupancy of a camp site is cancelled by the Park Ranger.

Liability

  • Tauranga City Council shall not be held responsible for the loss, theft or damage of any property for any reason regardless of the cause, including (without limitation) any fault pertaining to any fitting, appliance or piece of apparatus within the vicinity of the Park.
  • Campers are responsible for ensuring valuables are secure and vehicles are locked at all times.
  • Camping at the Park is at campers own risk.
  • Campers shall be liable to Tauranga City Council for, and shall indemnify Tauranga City Council from and against, any loss, cost or liability incurred by Tauranga City Council (including, without limitation, any associated Tauranga City Council staff time and any legal costs):
    • to remedy, restore or replace any part of the Park’s facilities or chattels damaged due to any wilful or negligent act or omission by a camper; and
    • arising from any breach by a camper of these terms and conditions.

Lost Property

  • Will be held by the Park Ranger and donated to charity after a three (3) month period.

Safety

Emergency Response

  • In the event of an emergency dial 111.
  • First aid supplies and a defibrillator are available in the Park by contacting the Park Ranger.
  • For Park Ranger assistance after hours call Tauranga City Council on (07) 577 7000.

Personal and Group Safety

  • The Park is a remote area with limited cell phone reception in places.
  • Please ensure you and your group are adequately equipped, experienced and aware of potential hazards.
  • Swim safe. Never swim alone. If in doubt, stay out of the water.
  • Rope swings are not permitted.
  • Know your limits. Read and obey the safety signs.
  • ALWAYS SUPERVISE CHILDREN NEAR WATER

Fires

  • Open fires and fireworks are prohibited within the Park.

Portable Barbecues:

  • Solid fuel barbeques cannot be used from 1 December to 31 March or during a prohibited fire season.
  • Ensure any ashes are cold. Ashes MUST be removed from the Park as part of your rubbish.
  • Portable gas barbecues are allowed at all times.

Potable Water Supply

  • The water supply in the Park is filtered and safe to drink without boiling.
  • Water is a precious resource. Please conserve water by using only what you require.

Pest control Stations

  • Animal pest control stations are located throughout the Park. For your safety and the effectiveness of the pest control station, please keep children away from them and do not touch them.

Boats and Water craft

  • No powered water craft are permitted in the Park.
  • Life jackets or flotation devices are recommended at all times when using the water.
  • No swimming or boating is permitted downstream of the lower catchment boom

Fishing

  • Fishing in the Park requires a Fishing Licence. Licences are not sold at the Park. Licences are available from Fish and Game New Zealand.

Online services terms and conditions

General

Tauranga City Council ("Council") has online facilities that enable certain services and transactions to be carried out through the Council website ("online services"). All online services are subject to these terms and conditions as well as the Council website terms and conditions, which are incorporated herein by reference.

Website terms of use

Use of online services

Council makes the online services available for your personal and/or internal business purposes. You may use information provided to you through your use of the online services solely for your personal and/or internal business purposes, provided that you:

  • Do not remove any proprietary rights notices
  • Do not modify, or make available, the information supplied or the Online Services itself, to any third parties through a networked computer environment; and
  • Do not make any additional representations or warranties regarding the information.

You agree not to use the online services for any improper, injurious, offensive or unlawful purposes and not to damage or disrupt the online services.

You are responsible for any actions you take and all outcomes based on information obtained through your access and use of the online services.

Information and privacy

You hereby authorise the Council to receive and collect information about you (including information about your online transactions) from time to time through the Council website. Any such information collected shall be treated in accordance with the Council’s Privacy Policy. The Council may disclose information about you (including your identity) to a third party if:

  • It is necessary to carry out, or facilitate the use of, the online services
  • You have authorised such disclosure
  • The Council is requested to do so in the course of a criminal or other legal investigation; or
  • The Council determines that disclosure is necessary in connection with any complaint regarding your use of the Council website

Confidentiality

Certain information can be made confidential and a request can be made for the same. The final discretion for making any information confidential lies with the Council. You acknowledge and agree that the Council may choose not to supply you with any information that it has made confidential, and/or you will comply with any confidentiality obligations notified to you by the Council. You are able to request further details regarding confidential information by contacting the Council.

Consent for Council to receive and store information in electronic form

Use of the online services means that you agree to provide through electronic means any relevant information, documents and attachments in the format and to the standards described for each online service. It also means you agree and understand that the information will be retained in electronic form.

Consent for Council to provide you with information in electronic form

Use of the online services means that you agree to receive (if nominated) information through electronic means. Where information is requested by another person, the requesting party is deemed to be the recipient’s agent and is presumed to have obtained the consent of the recipient to receive in electronic format.

Registration

Certain online services require you to register and obtain a username and password to verify your identity and enable access to the online services. You agree that all information provided to the Council by you in relation to your registration shall be current, complete and accurate.

Password Security

If you are required to select a password to use or have access to an online service, the Council recommends the password you select should not relate to any readily accessible data such as your name, birth date, address, telephone number, drivers licence, licence plate or passport. Nor may it be an obvious combination of letters and numbers, including sequential or same numbers or letters. You are entirely responsible for maintaining the security of your username and password, and for all activity which occurs on or through your account, whether authorised or unauthorised, including use by current and former employees if you are a corporate entity. You should change your password immediately if you believe that your username and password have been used without authorisation and advise the Council of this. The Council shall not have any liability for your failure to comply with these obligations.

Security

Online services are provided through a secure website. However, you acknowledge and agree that internet transmissions are never entirely secure or private, and that any message or information you send to or through to the Council website (including credit card information) may be read or intercepted by others, even where a website has stated as being secure. The Council shall have no liability for the interception, "hacking" or other unauthorised access of information through the Council website or any other website, by unauthorised third parties.

Your warranties

By using an online service, you represent and warrant that you are 18 years or older and have the appropriate authority and legal capacity to validly accept these online services terms and conditions. If you are using a credit card to carry out an online service, you represent and warrant that the credit card is issued in your name and that you will pay all charges incurred while using the Online Services. If you are accessing or using an online service through a registered account, you represent and warrant that you are authorised to use the username and password to such account.

Accuracy and binding nature of information

Before completing a transaction, you will be presented with a confirmation screen verifying the transaction details you wish to process. It is your responsibility to verify that all transaction information and other details are correct. You should print the transaction confirmation for future reference and your files. The Council shall have no liability for transactions which are incorrect as a result of inaccurate data entry in the course of providing online services or for loss of data or information caused by the factors outside of the Council’s control.

Limitation of liability

Except as expressly prohibited by law, in no event will the Council be liable to you for any direct, indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even where the Council has been advised of the possibility of such damages occurring. If, notwithstanding the foregoing, the Council is found to be liable to you for any damage or loss which arises as a result of your use of, or inability to use, the Council website, the Council’s liability shall not exceed the dollar amount of the transaction which formed the basis of the damage or $100.00, whichever is the lesser. Some jurisdictions do not permit the exclusion of implied warranties, and if you are in one of those jurisdictions, these exclusions may not apply to you.

Right to suspend, alter or cancel online services

The Council shall be entitled at any time, without prior notice or any liability to you, to suspend, alter or cancel any of the online services and/or to substitute alternative online services, which may or may not be interactive or transactional in nature.

Specific terms and conditions

You acknowledge that certain online services made available or offered by Tauranga City Council from time to time may be subject to specific additional terms and conditions. You agree to review and comply with any such additional terms and conditions. Access and use of any online service shall be deemed to constitute acceptance of any such additional terms and conditions applicable to such service. Where there is an inconsistency between the specific terms and conditions and these online services terms and conditions, the specific terms and conditions will take precedence.
